By placing a bid, the bidder signifies that they have examined the property to their satisfaction. This is a cash sale, which means potential buyers must have their financial arrangements secured prior to bidding. There will be no buyer contingencies offered or accepted for financing, inspections, or appraisals.
Buyer(s) and Sellers agree to execute a written purchase agreement within 24 hours of auction closing and to deposit, with RE Broker/Auctioneer Dan Clark, a nonrefundable earnest money payment of 15% of the purchase price. The non-refundable earnest money payment will be made payable to the closing agency, Titles of Dakota, Winner, SD. Buyers who are unable to close will be in default and the earnest money will not be forfeited.
All prospective buyers that have no prior real estate purchase/business history with Dan Clark Auction & Realty, LLC shall be required to submit a letter of credit or proof of funds from an FDIC-insured lending institution or financial services company prior to being approved to bid. Dan Clark Auction & Realty, LLC and the Sellers shall have absolute discretion and authority to qualify or not qualify potential bidders. Balance of the purchase price is due in certified funds at closing on or before August 29, 2025, the buyer(s) will take full possession after final payment at the date of the closing. The closing service fee that is charged by the closing agency shall be divided equally between the buyer and the sellers. Conveyance of marketable title will be transferred by Warranty Deed. The owner's title insurance policy will be provided with the cost of title insurance fees will be divided equally between buyers and sellers. A 2024 Real Estate taxes will be paid by the Sellers. 2025 Real Estate taxes due and payable in 2026 shall be prorated to the date of the closing, based on the most current county information.
